Introduction
Michigan Economic Development Corporation (“MEDC,” “our,” “us,” or “we”) is proud to offer the Michigan Career Portal, located at themichiganlife.org (the “Platform”), as part of the You Can in Michigan initiative, which provides a service to connect job seekers and employers (the “Services”).
MEDC has created this Privacy Policy to demonstrate its commitment to user privacy and online data security, and to communicate its online information gathering, use and dissemination practices for users of the Platform and of its Services. This Privacy Policy along with our Terms & Conditions (“Terms”) govern your access to and use of the Platform and the Services. By accessing or using our Services or the Platform, you agree to comply with and be bounds by our Terms and consent to the collection, use, sharing, and other disclosures of your personal information, as set forth in more detail below.

We may update this Privacy Policy time to time, and your continued use of our Services or the Platform constitutes acceptance of any changes.
Information Collected
a. Information Automatically Collected
If you do nothing during your visit but browse through the Platform, we will gather and store certain information about your visit automatically. This information does not identify you personally. This information may include, but is not limited to, your IP address, browser type, domain names, access times and referring website addresses. We use this information to be able to provide the Services, to maintain quality of the Services, and to provide general statistics regarding use of the Platform.
b. Information You Provide to Us
If you choose to provide us with personal information either while on the Platform, or in responding via email or completing a survey in connection with a feature provided on the Platform, we use that information to respond to your message and to help us provide you with information that you request. We do not capture any such personal information without your knowledge or consent, including as follows based on your use of the Platform:
For Job Seekers: To be able to take advantage of the Platform and Services as a job seeker, you will have to provide information about yourself, including your name, contact information (including phone number, email, and state of residence), employment interests, employment history, educational information, skills, licenses, certifications, and other credentials, etc., By uploading your resume/CV, which includes personal information, you consent to its use by employers registered on the Platform for employment purposes and as otherwise set forth in this Privacy Policy. You also agree that the information you provided is accurate, complete, and up-to-date.
Under no circumstances are you to provide your social security number or bank account information when using the Platform.
For Employers: To be able to take advantage of the Platform and Services as an employer agent, you will have to provide information about yourself and your employer, including your name, business contact information, employer, employer address, business contact information (including phone number, email, and location of job opportunity), information about the job posting (including job description, pay/benefit information, etc.) By accessing the Platform, you agree to use any personal data and resumes/CVs of job seekers strictly for recruitment and employment purposes, in compliance with all applicable laws and regulations and that you may not use any such information for any other purpose.
c. Cookie Policy
To enhance your experience on the Platform, the MEDC uses a standard feature found in browser software called a “cookie.”
A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server. By showing how and when visitors use the Platform, cookies help us track user trends and patterns. Cookies also prevent you from having to re-enter your preferences on certain areas of the Platform when you have entered preference information before. The Platform may use different cookie types as described below:
• Strictly Necessary Cookies: These cookies are required to use the Platform. For example, Strictly Necessary Cookies adjust the Platform’s data transmitted to match your Internet connection, get you to the secure versions of the Platform, and help provide services you specifically request. We use Google Analytics to analyze the use of the Platform. Our analytics service provider generates statistical and other information about website use by means of cookies. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity. HOW MEDC MAY USE AND SHARE YOUR PERSONAL INFORMATION
Job Seeker personal information will be available to Employers via the Platform that are interacting with the Services. Use of Job Seeker personal information is strictly limited to recruitment and employment purposes.
We may use personal data provided to:
· Provide information or Services requested by you;
· Manage our relationship with you;
· Improving the effectiveness of our Platform, marketing endeavors, and Services;
· Detect, investigate, and prevent fraudulent transactions and other illegal or unauthorized activities and protect our rights and property;
· Provide customer service;
· Notify you of any information concerning the Services;
· Send you automated email messages, text messages (message and data rates may apply), or marketing materials regarding our Services;
· Send you newsletters and other communications that you can opt-out of;
· Send you direct mail offerings;
· Send you email communications about our Services, promotions, events, or other important information that you opt into;
· Send you email communications about content you included on our Services;
· Send you technical notices, updates, security alerts, and support messages;
· Enable you to participate in the Platform’s features;
· Identify your Services preferences and informing you of new or additional products, services, and promotions that may be of interest to you;
· For internal business purposes such as trainings and business development;
· Notifying you about important changes to our Website; and
· For purposes disclosed at the time you provide your information or as otherwise discussed in this Privacy Policy.
You can unsubscribe from these notifications at anytime. You may not be able to unsubscribe to transactional messages that are required in our provided Services to you at your request.
We will not disclose user personal data to any third party other than employers that been determined to fit within the purpose and partner agencies solely for recruitment and employment purposes.
Except as otherwise provided in this Privacy Policy, any information you submit will not be shared with, disclosed or distributed to third parties, except that MEDC may disclose your personal information when required to do so by law, for example, in response to a court order or a subpoena, in response to a Michigan Freedom of Information Act request, when requested by a law enforcement agency and/or when MEDC has reason to believe that someone is causing injury to or interference with the rights or property of another. MEDC may also disclosure your personal information in order to enforce any of its policies, to ward against any fraud, issues with security, criminal activity, etc.
MEDC’s Protection and Use of Your Personal Information
MEDC stores your personal information in its secure database, and will take appropriate measures to safeguard personal information against unauthorized disclosure or use.
Opt-Out Policy
You have the option to opt out of being contacted by or receiving information from MEDC, its sponsors, affiliates and/or partners, and to choose how MEDC uses your personal information. You may also review, update and correct your personal information. You may exercise these options by sending an email with your request to talent@michigan.org.
Exceptions to Protection of Personal Information
MEDC’s obligations under this Privacy Policy do not apply to any information or data that: (a) is not identifiable as yours; (b) is or becomes entirely in the public domain; (c) was known to the MEDC prior to its access to the information or data; (d) received lawfully from a third party through no breach of any obligation of confidentiality owed to you; and/or (e) created by MEDC independently of its access to, or use of, your personal information.
Security
MEDC has put in place appropriate physical, electronic and managerial procedures to safeguard and help prevent unauthorized access, maintain data security and correctly use the information we collect online.
RENTION OF INFORMATION
We retain personal information that we collect until it is no longer necessary to fulfil the purpose it is being used for, as required by applicable laws, or until you ask us to delete it.
MINORS AND COPPA COMPLIANCE
The Services are only available for adults 18 or older. If you are under 18, you may use our Platform only through a parent or guardian. In cases where you - a parent or guardian - have authorized a minor under 18 to use our Platform, you recognize that you are fully responsible for: (i) the online conduct of such minor; (ii) controlling the minor's access to and use of our Platform; and (iii) the consequences of any misuse by the minor. You acknowledge that we have no obligation to monitor the content accessible on or through our Platform.
Children under 13 years of age are prohibited from using the Services and the Platform. No one under age 13 may provide any information to or on the Platform. We do not knowingly collect Personal Information from children under 13, even with verified parental or guardian consent. If you are under 13, you are prohibited from providing us with any personal information about yourself, including your name, address, telephone number, email address, or any screen name or user name you may use.
If we learn we have collected or received personal information from a child under 13, we will delete that information in accordance with the Children's Online Privacy Protection Act (“COPPA”). If you believe we might have any information from or about a child under 13, please contact us at talent@michigan.org, and we will take reasonable steps to ensure that such information is deleted from our records.
DO NOT TRACK
Do Not Track is a privacy preference that Visitors can set in their web browsers. When a Visitor turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the Visitor. At this time, we do not respond to web browser “do not track” settings or signals. We may deploy technologies on our Services to collect information about you and your browsing activity, even if you have turned on the Do Not Track signal.
TRANSFER OF DATA
Your Personal Information may be transferred to--and maintained on--computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction. We will take steps reasonably designed to treat your Personal Information securely and in accordance with this Privacy Policy, as further described below.
